1. scope of application

These General Terms and Conditions (GTC) apply to all orders, deliveries and services placed via the exclusive-spirit.ch website or directly with:

By placing an order, the customer agrees to these GTC.

2. offer and conclusion of contract

The products shown on the website do not constitute a legally binding offer,
but a non-binding invitation to order.

A purchase contract is concluded as soon as the provider confirms the order by e-mail
or the goods are dispatched.

The supplier reserves the right to refuse orders without giving reasons.

3. products

The provider distributes in particular:

  • Spirits
  • Meat products
  • Jams
  • Other agricultural products

4. prices

All prices are in Swiss francs (CHF) unless otherwise stated.

Domestic Switzerland: excl. statutory VAT, as VAT free (agricultural business).

EU deliveries: Prices may be calculated without Swiss VAT depending on the country;
Import duties, customs duties and local taxes shall be borne by the customer.

Shipping costs are shown separately.

Prices are subject to change without notice. The prices valid at the time of ordering apply.

5. terms of payment

The following payment methods can be offered (according to the website):

  • Prepayment
  • Credit card
  • TWINT
  • Invoice (by arrangement)

The provider reserves the right to exclude individual payment methods.

In the event of late payment, reminder fees and interest on arrears may be charged.

6. delivery

Delivery area

  • Switzerland
  • EU countries

Delivery shall be made to the address specified by the customer.

Delivery periods are non-binding unless expressly guaranteed in writing.

EU deliveries

Deliveries to EU countries may be subject to customs duties, import taxes or other charges.
These are to be borne by the customer. The provider assumes no liability for delays caused by customs authorities.

7. reservation of title

The goods remain the property of the supplier until full payment has been made.

8. revocation and return

Under Swiss law, there is no statutory right of withdrawal.

A voluntary return may be granted:

  • within 14 days of receipt
  • only for unopened, undamaged goods
  • in original packaging
  • Return costs shall be borne by the customer

Excluded from the return are

  • Opened spirits
  • Perishable goods (especially meat products)
  • Customized products

In the event of justified complaints (e.g. transport damage), the supplier must be notified within 48 hours.
in writing upon receipt.

9. protection of minors

Alcoholic beverages are sold exclusively to:

  • Persons aged 18 and over (spirits)

By placing an order, the customer confirms that they have reached the legally required minimum age.

The provider reserves the right to carry out age checks (e.g. age check on delivery).

10. liability

The provider is only liable for damages caused by intentional or grossly negligent behavior.

Any liability for:

  • Indirect damage
  • Consequential damage
  • lost profit

is excluded to the extent permitted by law.

The supplier accepts no liability for improper storage or use of the products by the customer.

11. food and hygiene instructions

Meat and food products must be stored in a cool place and consumed in accordance with the instructions given.

The customer is responsible for proper storage after receipt of the goods.

12. data protection

Personal data is processed in accordance with the applicable Swiss data protection legislation (revDSG).
and - where applicable - the EU GDPR.

13. shipping and delivery conditions

Orders from Exclusive Spirit are within 1-3 working days from order date processed and shipped if the goods are in stock and no other agreement has been made.

Delivery is as follows:

  • Switzerland (CH): Shipping by A Mail

  • EU countries: Shipping by B Mail

The actual delivery time depends on the delivery times of the respective shipping service provider and may vary depending on the destination. There is no shipping on weekends and public holidays.

Should there be any exceptional delays in delivery, the customer will be informed accordingly.

14 Place of jurisdiction and applicable law

Swiss law applies exclusively.

The place of jurisdiction is 6037 Root, Switzerland, provided there are no mandatory legal provisions to the contrary.

15. severability clause

Should individual provisions of these GTC be invalid in whole or in part,
shall not affect the validity of the remaining provisions.
